Sponsorship terms

You are buying the right to hold one specific, named placement on toiletspace.lol for as long as nobody pays more for it. When your payment is confirmed by our payment provider, you become that placement’s current holder: your brand is shown on it, and your name is added permanently to its public record of holders. Another buyer may take the placement from you at any time by paying more, as described in clause 3. What is permanent is the record that you held it - not the placement itself. That is the whole product.

It is a novelty sponsorship and vanity placement. It is not an advertising campaign, a media buy, a security, an investment, a share of anything, or a financial product of any kind. No advertising performance of any sort is part of what you are buying.

You must be at least 18 years old. If you purchase for a brand or company, you represent that you are authorised to act for it and that all details you submit (name, logo, link, tagline) are accurate and yours to use. You are solely responsible for the content you submit.

Every placement opens at $1 while nobody holds it. Once somebody holds it, the price to take it is always one dollar more than the current holder paid. There is no auction, no bidding window and no reserve: the price is fixed at any given moment, and the first confirmed payment at that price takes the placement.

Starting checkout reserves the placement for you for approximately 3 minutes while you complete payment; while it is reserved nobody else can start checkout on it. If payment is not completed in that window the reservation lapses automatically.

When your payment is confirmed you become the current holder and the previous holder ceases to be. Being outbid does not entitle you to a refund, and you acquire no right to be notified, to match a later price, or to reclaim a placement you previously held. Your entry in that placement’s public record of holders is permanent and is not removed when the placement changes hands.

In the rare case that two payments are captured for the same placement at close to the same moment, only one purchase can succeed. Whichever payment is recorded first becomes the holder; the other payment is refunded in full, and that buyer acquires no placement, right or claim of any kind.

All purchases are processed by Dodo Payments, which acts as merchant of record for the transaction. Dodo issues your receipt and invoice, applies any applicable taxes (prices are displayed tax-inclusive where applicable), and handles payment disputes and chargebacks under its own terms. We never see or store your card details.

Each placement has one exact price at any moment, derived under clause 3 and shown on its placement page. Before checkout starts we re-verify server-side that the placement is still buyable at that price; if another buyer’s payment has just settled, or someone else is mid-checkout, yours is refused rather than started.

Because each purchase is for a specific placement at a specific, named price, and a later takeover supersedes it rather than reversing it, purchases are final. Once your payment is confirmed, it is non-refundable, except: where required by applicable law; where a losing payment is auto-refunded under clause 3; or where the Operator, in its sole discretion, refunds a payment that could not be turned into an active placement for reasons on our side.

Nothing in this clause limits any non-waivable statutory right you may have under applicable consumer law.

No traffic, impressions, views, clicks, leads, sales, brand lift, return on spend or outcome of any sort is promised, projected or guaranteed. Any “metrics” shown on this site are jokes and are labelled as such. Nothing in this bathroom is measured.

Treat the amount you pay as money spent on a novelty, because that is what it is.

Physical installation is a milestone, not part of the purchase itself. When you have held a placement for 7 consecutive days without being outbid, the intention is to print your logo, place it physically on the corresponding real object, photograph it, and publish the photo on your placement page marked “Installed IRL”. If you are outbid before completing 7 consecutive days, no installation is owed for that hold, and that does not entitle you to any refund.

Your digital placement and your entry in the record go live immediately on payment and do not depend on physical installation. We maintain the physical installation on a reasonable-efforts basis for as long as the project operates - it is not weatherproof, permanent or insured, and it may be repositioned, re-printed, refreshed or replaced by a later qualifying holder’s logo at the Operator’s discretion. We do not promise the physical object, the installation or the Site itself will exist forever (see clause 12); what is permanent is the record that you held that placement, per clause 10.

Submitted logos, names, taglines and destination URLs may be reviewed at any time, before or after your placement goes live. The Operator may refuse to publish, or may hide or edit, at its sole discretion, any submitted content that is or links to: illegal content; sexual or adult content; hateful, harassing or extremist content; malware, phishing or deceptive schemes; impersonation; content infringing third-party rights; or content that in the Operator’s judgment creates legal or reputational risk.

Declining or hiding content for these reasons does not entitle you to a refund and does not entitle you to a refund and does not end your hold on the placement - you remain its holder until somebody pays more. Where content is hidden, we may invite you to submit a compliant replacement; until then, the placement may display without your brand content.

You keep all rights in your trademarks, logo and brand. By submitting them you grant the Operator a non-exclusive, worldwide, royalty-free licence to display, resize, print, photograph and publish them - on the Site, on the physical object, and in the Operator’s marketing and social media - for the purpose of running your placement and showing the permanent historical record of everyone who has held each placement.

You confirm you have the right to grant that licence for everything you upload. You may in turn state publicly that you hold, or have held, your placement at ToiletSpace.lol.

Your purchase is recorded permanently. Your brand, the placement you took, the amount you paid and the dates you held it remain publicly visible on the Site for as long as it operates, and a later holder does not erase or replace your entry. This record - not the placement, which you hold only until somebody pays more - is the part of your purchase that is permanent.

We may, but are not obliged to, offer other sponsorship placements in the future, on other objects, spaces or terms, and we may add or withdraw placements on this Site at any time. Buying or holding a placement gives you no right, priority, discount or claim of any kind to any future offering.

No uptime, availability or lifespan of the Site is guaranteed. This is a joke website about a bathroom. It may be modified, suspended, taken down, moved or discontinued at any time, and that does not entitle you to a refund of a payment already made.

Prices are shown in USD. A placement’s price at any moment is the amount its current holder paid plus one dollar, or its $1 opening price while nobody holds it - see the placement page for the exact figure. There is no traditional auction: at any moment there is one fixed price, and the first confirmed payment at that price takes the placement. A placement is never permanently withdrawn from sale merely because it has been bought.

The limitation of liability and indemnification clauses of the Terms of Use apply to every placement. In particular, the Operator’s total liability in connection with a placement shall not exceed the amount actually received for that placement, and you indemnify the Operator against claims arising from the content you submit.

These terms are governed by the laws of the State of Israel; the competent courts of Tel Aviv-Yafo have exclusive jurisdiction, as set out in the Terms of Use.
